You're overthinking it. The other half will come once the repair is completed or vehicle bought back.
I don't think we're overthinking it. The Bosch settlement and the VW settlement are different and have different terms. Unlike the VW settlement, the Bosch settlement is merely a payment to owners with no fix or buyback obligation on the buyer. In other words, you don't need to participate in the VW settlement to get the Bosch money. Typically, settlements are paid as one payment unless the settlement agreement provides something else. The VW settlement has specific language allowing for a split payment due to the potential fix for 3.0 Gen II. The Bosch settlement doesn't. So I'm not cashing the Bosch check for half of the total until I know it isn't going to release the remainder.

I THINK you are overthinking, providing that you're a new member here.

Understood, but from the spirit of the settlement documents, yes you receive half of the restitution now and you'll receive the other half when you bring the car for repair if there is one. If you sell the car now the new owner will get the other half when s/he brings it for the fix.

So just to confirm, there's no specific provison in the settlement agreement that was the subject of one of the largest class affirms ever allowing Bosch to withhold 10s of millions from class members. I think I will send an email to Class Counsel.

I wouldn't infer that. It seems like it is a tool to ensure people will get the fix...IF...it is approved. Just like the VW restitution money.
If the fix is approved - I have no plans to put back the emissions equipment on the Treg...and claim the balance of the VW restitution money.

Can Bosch refuse the full payment if I do not get the fix?

Isn't there a 90 day provision on the checks? I would look at one of mine but I cashed them all yesterday. :cool:

Looks like four checks from Bosch coming today, which should be all that are coming so far (haven't filed the claim for the A3 yet; haven't decided whether we want to keep the car or sell it back). They would cover 3 x 2.0 and 1 x 3.0. I'm away for a few days, so won't know the amounts until this weekend.
So the four checks were two for $175, one for $350, and one for $750. I'd previously gotten another $350 check. So, out of four 2.0 TDIs, two had previous owner claims and the other two didn't. The 3.0 didn't have a previous owner claim, but apparently Bosch is splitting the payment, as already noted here (and I also don't see any authority in the settlement agreement for them to do so).

So I also got a check from Bosch. Mine is also $750, I'm assuming the rest comes after a buyback/fix?

I'm curious where you see that in the spirit of the Bosch settlement documents, especially considering that it's a much simpler settlement (there's only one agreement, rather than six in total with VW). Because I don't recall seeing anything that even hinted at the possibility that they'd do anything other than pay the full amount on confirmation of eligibility.

Turned in 2 TDI's and just got our 2nd Bosh, $350.00 check yesterday. Looks like the money tree is done producing fruit for us. Love the 2015 TDI!

The checks from Bosch state, "By endorsing and depositing this check, I acknowledge the individual release of Claims set forth in the Bosch Settlement."
If Bosch actually is splitting the payments into two installments, then they should not have this statement on the checks (Because you're still entitled to receive the other half)

I also find no where in the Bosch settlement that allows them to wait to pay 50% until after emissions modification.
Owners of vehicles with no eligible previous owner should receive a check for the full amount stated in the BOSCH Settlement.

Although there is no provision for Bosch to withhold 50% of the compensation until a later date, they have no deadline, so they may be holding off on the full amount until they can confirm the absence of an eligible seller.

I don't think the 50% payments from Bosch have anything to do with the emissions modification.

I don't think this is what's going on. First, the deadline for Eligible Sellers/Former Owners to file, even with Bosch, is long since past. Second, that doesn't explain what's going on with this post. That guy had a 2015 2.0, got (stage 1 of) the fix, and just got a check for ~$117--67% of $175. The only explanation I see for that number is that (1) there was an Eligible Seller claim, to whom Bosch paid $175, and (2) they paid 2/3 of the remaining $175 to the current owner. Presumably they'll pay the rest when he gets stage 2 done, but of course they're giving zero details on how they're coming up with their numbers.

We agree on these two points.^^

With the scrutiny involving "dieselgate" I would be very hard pressed to believe that they are intending to defraud 80K 3.0 owners. Stranger things have happened, but I can't think of any off the top of my head.

My emissions mod was completed on August 21 and I just go the check from Bosch today, September 21.

How are people receiving their checks quicker than others here?

My buyback was on April 15th and I have yet to receive mine!

We're receiving them in the order Bosch sends them, which appears to be almost completely random. The checks I got the other day accounted for a car sold back in December, a Q5 I saw them about in July, and two others.

I called and confirmed with Bosch that they are mirroring the VW settlement on the 3.0 fix and only paying half now and half later.

Funny thing is, I have received 3 of the 6 checks that I am expecting. The 3.0 check was the most recent transaction and I received the check quickly but others it has been almost 10 months.

I am the original owner of a 2015 sportwagen tdi purchased in July 2015. Did the fix in June 2017. Received a check from Bosch for 234.50. Emailed Bosch they said we would receive the reminder 1/3 shortly after we receive the 1/3 from VW. So another year to get the $115.50.

Yes, from all indications within this site and 'vortex, random seems to fit best when addressing the (hopefully $350.00 American dollars) payment.

Just passing along my experience. My buyback was on 8/14 and I received the Bosch check for $350 last week.

I had my Gen 1 jetta 'fixed' 3 weeks ago. Nothing yet from Bosch. Anyone with a fixed Gen 1 got theirs yet?

What does the envelope look like? Does it say Bosch or settlement? Or is it from a 3rd party fulfillment company?
