Maybe selling the 2009 and buying the 2015 might not of been a bad idea. I still have 150k to go before I think about buying another car :)

probably just a delay while they negotiate

the current application was withdrawn, but that does not mean there won't be a new one, later, after everything gets sorted with the regulators.

the fix will be software.

From Horn's statement:

"In Volkswagen’s recent ongoing discussions with the regulators, we described to the EPA and CARB that our emissions control strategy also included a software feature that should be disclosed to and approved by them as an auxiliary emissions control device (“AECD”) in connection with the certification process. As a result, we have withdrawn the application for certification of our model year 2016 vehicles. We are working with the agencies to continue the certification process. "

Basically they pulled the initial application, but are reapplying. It's a new piece of info that effectively gives us zero clarity.

Given the political climate in the hearing room today at the House of Representatives getting a application for EPA approval completed interim or final will be next to impossible.
VW is likely going to have to demonstrate that the new firmware solves the emissions problem and does not adversely effect the safety of the car in anyway. This testing and firmware validation process will be done by an outside independent organization since VW has essentially shown that they can't be trusted.
Given the time VW has had to work on the problem if a firmware flash would fix the problem why didn't VW do on their own and spare themselves the truble they are in?

Funny how the House can be indignant when an agency they oversee has so obviously failed at fulfilling its mission and protecting us. And using a third party to test isn't a surprise: the EPA has demonstrated they're not capable.

That's politics. You have people monologing in front of the camera in front of an empty camber. Every hearing they try to pick apart the witness in front of the camera and then they go back to sleep once the cameras are off. Sadly its not just political nature, its human nature.

I'm glad I got my 2015 when I did. With the recent studies showing virtually all passenger diesel's from all manufacturers non-compliant for Nox emissions in Europe, I'm guessing it's the same here in the USA. May not be a new diesel passenger car in anyone's future.
