While I don't plan on doing it, anyone who does get rejected due to condition, should probably contact the class counsel. Condition is not in the settlement.
Missing is a condition, since it could have rusted off and fallen to the ground, something being on the car or not on the car is condition.

For items on the sticker that were not compensated, they clearly add no value, so them not being there should similarly remove no value.

someone on FB said they were dinged on their payment due to cracked windshield, but this was a lease return. Why would they lose money even if it was a lease? Condition is not specified for either lease or own, is it?

All condition requirements remain for leased vehicles.
The only thing waived is the early terminations fees. All other lease conditions apply, including turn-in fees as well (usually charged if you don't buy/lease another car at the time of turn in, regardless of the turn-in reason).

At the moment I'm in the limbo department on this one. Damaged on Nov 23. It all depends on what the actual definition of "operable" is, and I'm not getting a straight answer from anyone. So, I've given up on the "no help" phone line, and called the sales manager at the dealer to either (a) have him ask the buyback specialist or preferably (b) give me the buyback specialist's contact info so I can ask directly (and get an answer in writing).

I paid off the loan so I can have a clean title, and when the title comes I'm either going to take the 'totaled' payout from insurance and then get the low dollar restitution, or the lower insurance payout and the buyback. But I'm not committing one way or the other until I get a straight answer from VW about what operable means.

2.50. “Operable” means a vehicle that can be driven under its own 2.0-liter TDI engine
power. A vehicle is not Operable if it had a Branded Title of Assembled, Dismantled, Flood,
Junk, Rebuilt, Reconstructed, or Salvaged on September 18, 2015, and was acquired by any
person or entity from a junkyard or salvage yard after September 18, 2015.

Lucky me. We crashed the buyback app. I now have no car AND no receipt for it! no one could hand write one. It all is generated by the APP. Yes, the same app that was crashed and had IT & VW unable to process any more claims.

I did not leave my car, had to re-schedule. Do not trust VW at all.

I got into a no fault accident on 10/27/16, cosmetic front end damage (buckled hood, no front bumper, and needs an alignment), I certainly didn't get it fixed. Car drives just fine tho there are some CEL's for washer fluid, bulbs, etc.. It's driveable, runs under it's own power, will be handed over in the same condition meeting all stipulations of the settlement agreement.

No, I'm expressing serious frustration at VW, who doesn't seem to be willing to say it either. Neither at the no-help line, or from anyone who will answer a phone at a dealer (including the "buyback ambassador"). What's difficult about saying....or putting on the non-useful FAQ..."here's what operable means". It's almost as much fun as getting a "what's covered" question answered by a medical insurance agent.

You REALLY need to just contact the attorneys for the plaintiffs in this case. They will gladly talk to you about it and give you their opinion which will carry far more weight than anyone's on here. VW isn't going to tell you you can or can't do something because the only people they've made available to ask are minimum wage call center folks who answer basic questions from a script. Call or email the lawyers.

I see you're from Asheville - I lived in Waynesville for 10 years prior to moving to Greensboro.

I still have a place in Maggie Valley - I cannot wait to get back up that way and eat at 12 Bones!

I got a response from "Ajay" at the lawyer's office, and the answer is, no matter what some mechanic at the dealer service shop tells you, is that the engine has to start and run, and the vehicle has to move under it's own power. Driving in circles, multiple turns, driving on the highway at speed, etc etc does not apply. And he gave me his phone number and extension in case I get a hassle.

Now all I'm waiting on is for VW credit to send me the title and release of lien so I can get the insurance payout and have the JSW dropped in my driveway....and an appointment for dropoff. I'm guessing it will be after Jan 1.

I talked to a guy the other day as he was washing his TDI. I asked him if he was really washing it before turning it in. He said that he just hates a dirty car. I was joking, but it turns out he is going to turn it in but still keeps it clean. I dont know if he is on this forum, but I just thought I would mention it in this thread since it's about turn-in condition.

Also, he said that he is looking at buying an ALH again. He loved his last one and wants another. My guess is that the turn in is a Monetary decision.

Because you don't like the line employees who have to deal with these cars? I can guarantee you that the VW execs won't even hear about this. It's like yelling at front line employees anywhere: all it does is make their job worse and you get nothing for it.

I can easily guess what others will be leaving...

I am thinking about running mine through a cheapie carwash before turn in. I sort of want to pick off all of the acorns and leaves as well.

And for that matter, last night I threw a set of VW cargo blocks in the back. We never used the things, and they were just taking up space and gathering dust.

Someone rear ended me on the highway at the end of October. Fortunately it was at very low speed and there really isn't any damage. I parked the car two days later and bought something else. Not running that risk again. Of course, now that I'm making double payments I'm getting a little anxious. Silly me, I thought 45 days from doc acceptance would have been enough time to resolve.

Mine is going back with some damage. A deer ran in front of the car damaging the bumper, hood, fender, HID headlight and fog lamp.
