Yeah, but an awful lot of people have completely wrong ideas about what that notary seal indicates. I think it's generally a good change, except that the change to the law invalidates any "generic" notary block out there, and there are a lot of them. There is a provision in the law that the special box and wording aren't necessary if the document isn't going to be used in CA, but it probably wouldn't apply here.

In this case, since the case is pending in CA, and the release specifies that any further action must only be in CA, they should have simply used the CA acknowledgement on the form. It's nothing that any other notary would object to.

My buyback was just approved today with the VW paperwork. Submitted 11/21. So either I got lucky, it's inconsistent, or VW decided to not make this an issue since they will be rejecting so many people.

I'm thinking it's inconsistent. I've heard of others who didn't have their paperwork accepted because addresses didn't match their current address and I had no issues with that, etc.

I *did* include the notary form because of what I read in this thread. Still waiting on my acceptance email. My TDI is just parked on the side of my house while I wait. Sigh.

My notarized offer letter was approved yesterday evening. I submitted the documents on 11/23 and only sent back the 7 pages (no CA specific notary page) so I was expecting it to be rejected.

I was told by vwoa to make sure nothing is to be crossed out. That i have to noterize the vw page 7 and the ca document. Or it would not be accepted. I wish they would all have the same answer. Your dammed if you do and dammed if you dont. Im going tomarrow to get noterized, hopefully they will noterize both

Mine was accepted with the section crossed out. VW may not know this, but I don't think CA notaries *can* notarize multiple pieces of paper for the same document even if they wanted to.

I just uploaded mine, so we'll see how fast they go.

One thing of note that really ticked me off. The offer download was a small text file so it was less than 100kb, but to scan these things in at a resolution they can read (especially the QR code) is really hard when they throw a 10MB limit on file size. I'm willing to bet a lot of these have been rejected based on how blurry these scans get when scanned at that low of resolution. It took me well over an hour to get it good enough that I thought it would not get rejected for that.

I used a scanner app on my iPhone. The PDF for 8 pages was only 2.8 MB. The images including QR codes were sharp. It took a minute to scan all pages. VW approved my docs in 2 days.

I wish I had know about that. I just used the flatbed scanner on my printer. Crossing my fingers that what I uploaded is good enough.

My notary actually took back the original notary page that came with the VW pack when she filled out the California Notary page. I believe I'd have to pay an additional $10 for the additional page nearest notary public, So she just switched the pages out and kept the original notary page.

The first time I uploaded my pages, I had scanned the pages using Genius Scan+ app on my iphone. I ended up just adding the additional California notary page to the already scanned (and rejected) pack VW sent me that I had already scanned.

Later that day I got an email that I could schedule my appointment.
There is nothing I can find that says that a notary cannot refuse to notarize a document. I don't see why not, but can a bank refuse to notarize documents for non-customers?

Why didn’t everybody in California just hire an auto fraud attorney? VW committed fraud and admitted to it. I got an attorney immediately after VW refused to take the car back. Auto fraud attorneys work on a contingency basis. You pay nothing and if VW is found guilty, they are obligated by CA law to pay all lawyer fees.

In order to sue as an individual, you would have had to opt out from the class suit years before the buyback even became a thing. And by doing so you would have limited yourself to whatever damages you could prove in court rather than the extremely generous court ordered settlement that was provided to primary and secondary owners. In any case, anyone who hired an attorney after a dealership refused to buyback their car would have been well past those windows. Generally speaking, CA follows the American Rule regarding legal fees, which states each party pays their own legal costs. There may be a specific statute stating otherwise in regards to fraud cases but without reviewing it I can't say definitively one way or the other.

Almost every Auto fraud and lemon law lawyer in California works on a contingency basis because the automakers are 100% responsible for your lawyer fees if they are found guilty. I lemon lawed a ford focus and got an attorney for this vehicle as well. Both resulted in full buy backs with 0 out of pocket. If I would’ve gotten more than what I paid for the vehicles in extra damages, they would have been entitled to 30% of the extra amount. Per the contract. What were the generous court settlements? I had a received a $5000 settlement option and refused since I had a lawyer and was convinced they had committed fraud and admitted to it.
