If VW buys back your JSW, what will you replace it with?

Contacted my Arizona department of eviornmental quality and they assured me here in AZ it's business as usual for emissions. In AZ all diesels are only tested for particulate matter and nothing else. So DEQ told me if the car passes that test, regardless of anything the feds say, it will be granted a registration. DEQ told me it is written that way into state law and only the legislature can change it. I was even told since it is a diesel no one should ever even be opening my hood and looking. They should only look under the vehicle for the catalytic converter with their mirror. I told the guy they always look under my hood and he said since it is a diesel they should not be. So if it passes the particulate matter test then it's good to go.

Not so much… to you but if VW fails to get 85% of the affected models recalled (for destruction) then they will be fined $85,000,000 for each percent below that court mandated level of 85% !

YIKES !

Reference: https://www.vwcourtsettlement.com/en/docs/Appendix A.pdf

6.1 Recall Rate Target. By no later than June 30, 2019, Settling Defendants shall remove from commerce in the United States and/or perform an Approved Emissions Modification on at least 85% of those 2.0 Liter Subject Vehicles that existed as of September 17, 2015, as defined below (“National Recall Target” for the “National Recall Rate”).

For purposes of this Paragraph, the total number of 2.0 Liter Subject Vehicles is 487,532 (499,406 vehicles less scrapped vehicles as of October 1, 2015 of 11,874). For purposes of this Paragraph, the total number of all 2.0 Liter Subject Vehicles registered in California is 70,814.

6.2 Approved Emissions Modification for Generation 3: N/A

6.3 Consequences of Failing to Meet Recall Target. If, by June 30, 2019, Settling Defendants fail to achieve the 85% Recall Rate Targets required by Paragraph 6.1, Settling Defendants shall make additional contributions (“Mitigation Trust Payments”) to the Environmental Mitigation Trust established pursuant to Appendix D of this Consent Decree. Such additional Mitigation Trust Payments shall be as follows:

6.3.1. National Mitigation Trust Payment. For failure to reach the National Recall Target, Settling Defendant shall contribute to the Environmental Mitigation Trust $85,000,000 for each 1% that the National Recall Rate falls short of the National Recall Target. In calculating any payment required under this subparagraph, the National Recall Rate shall be rounded to the nearest half percentage point. Any payments to the Environmental Mitigation Trust made pursuant to this subparagraph shall be used pursuant to the terms of Appendix D exclusively to fund environmental mitigation projects outside California.

6.3.2. California Mitigation Trust Payment. For failure to reach the California Recall Target, Settling Defendant shall contribute to the Environmental Mitigation Trust $13,500,000 for each 1% that the California Recall Rate falls short of the California Recall Rate Target. In calculating any payment required under this subparagraph, the California Recall Rate shall be rounded to the nearest half percentage point. Any payments to the Environmental Mitigation Trust made pursuant to this subparagraph shall be used pursuant to the terms of Appendix D exclusively to fund environmental mitigation projects in California.

P.S. GSW w/ 6spd Manual avail. in 2017 MY :D
You contradict yourself with your own quote. It's not 85% bought back, it's 85% bought back *OR FIXED* . . .

Registration Denial ?

I'm not sure what VW paying a fine has to do with me, if I can't get my car registered.
I keep reading comments like this and was curious to what extent people won't be able to register. At least during the next couple years, it would seem this would apply (taken from the bottom of page 3 on the Executive Summary)

States that accept money through the EPA/CARB settlement cannot refuse to register your vehicle as a result of the emissions problems at issue in this case. If any state does not accept money through the EPA/CARB settlement, it will not be bound by these settlements, but it is anticipated that Class Members will be allowed to drive their cars legally through the course of the Class Settlement Program, while they await their Buyback or Approved Emissions Modification

You drove a Yugo for ten years? Congrats, that must be a record! I thought the Renault LeCars my parents drove in the 80's were cheap, but with fiat reliability (haha) maybe they should have had Yugos.

Yes, there's a 6MT… in the 4Motion S edition !

That is looking like a great option! Only downside is that it will, at least initially, only be offered with a DSG transmission.
I'm just hoping the release of a 6-speed AWD VW Wagon is going to be nothing like the release of the 6-speed R last year.

Someone who really wants a manual?

There isn't that much in the upper trim levels that excite me all that much, and some of it I definitely don't want.

I have read reports about dealers that will connect up the seat heaters in S-trim cars (for a few extra bucks, of course).

Have a Tesla Model 3 on order, I'll wait and see.

In the meantime, it will either be a short term use Subaru Outback or Toyota RAV 4 Hybrid. Buying for my use until my daughter is old enough to drive, then it's hers. Yuk on the automatic for me, but safe and reliable for her.

Late in 2017 I'll see if the new Volvo V60 is out as a plug in hybrid and weigh that and the Tesla 3. Likely both may not be out until early 2018, but after 3 VW's, and a 2016 TDI Sportwagen on order never to be delivered, I'm done with these arrogant turkeys.

Either a 2017 Alltrack or (more likely) a 2016 Subaru Crosstrek. When it comes down to it I do so much camping, kayaking, and miscellaneous back road stuff I should really have more ground clearance. Poor little Golf has gotten stuck once or twice and I've had to turn around more then once due to rough road conditions. Also since my 100+ mile commute has disappeared (Company truck FTW!), I can deal with less MPG.

Still on the fence about keeping it though. I could always finish my plan to lift the car for more clearance and deal with FWD. But AWD is such a tempting option considering my choice of hobbies.

Having AWD or at the very least a limited slip differential would be better for what your needs are ;)

Just out of college I had a friend that drove a Yugo on an 80 mile commute. He said it was speed ticket proof. He'd be driving 70 down the road. Police radar goes off. Police sees it's a Yugo and assumes the radar must be broken.

JSW Unicorn

As for the options:

2. Do Nothing is a very attractive option, but carries some significant risk. I live in Massachusetts, which is a CARB state. But I do not know if the Registry of Motor Vehicles has the legal authority to deny registration to specific "singled-out" vehicles. (The rule is if OBD shows "OK" then its OK, and my JSW will show "OK".) And even if they don't, that is no guaranty that they won't get that authority at some point in the future-- whether by new regulations or by new legislation. So "do nothing" is essentially a gamble that the car won't wind up being a large paperweight.

3. That leaves the buyback, which is a pretty fair number, even for high-mileage cars like mine. Unfortunately the JSW TDI was a unicorn, which has a combination of characteristics that cannot be duplicated without the fudge that got us here. Which means, alas, that tradeoffs will have to be made. For me, I have to trade things off for space and utility--meaning something of similar size, hopefully similar comfort. Going to lose the 6MT, torque, and that lovely efficiency. CUVs trade away too much of all of those things. And the buyback number for me lands me very close to the MSRP of the gas-powered GSW. So, at this point, that is the front runner, especially if they are able to offer encouragement for me to stay with VW.
My biggest complaint with my 2012 JSW TDI was not enough ground clearance.
My favorite feature was the fuel economy.

My front runners for the replacement are
  • Subaru Forester (fix ground clearance)
  • Ford C-Max Hybrid or Energi (keep economy, but same old ground clearance).

I'm not sure if either will have the longevity of my TDI engine.

I really like the Crosstrek but the 2.0l engine is so anemic. If they come out with something that has a lil more guts for 2017 I may consider the Crosstrek. Otherwise it may be a Forester, except that they are so ugly...

I'll probably replace my '14 JSW TDI with an Acura TSX Sportwagen (used, they were last imported for the '14 model year) or a Volvo V60 wagon.

I'll be getting a five-speed with the Crosstrek, no good deal is going to stop that. At the end of the day the Crosstrek is a Subie and finding cheap bolt-on gains for a Subie is like finding a McDonalds, it's so easy its not even a challenge.

It's really the CVT that is the worst thing about the Crosstrek. Its a world of difference with a manual.

That's pretty much my experience with the Forrester. It drove okay, but it just lacks that involving feeling that vw offers. Many of the Mazdas feel very similar to a German car. While testing out a new Mazda 3 hatchback 2.5 I couldn't help but feel that it was very similar to my golf in ride quality, just a bit sportier. But with a bit more steering feel.

Well put. We have some friends with a Boxster and a Mazda 3. Sometimes they take the 3 on Porsche events commenting that "we stayed with them in the corners" :D
Our CX-5 inspires a similar reaction. It handles very well indeed for a vehicle with increased ground clearance.

This put a wrench in our plans as last fall we planned to sell our 13 JSW and get a new car for my wife, likely a Q5 or X3 (she wants to be higher off the ground). For a year or so, I would use her present car, an 04 Volvo XC70 that we have had since new and has been a great car, as my daily driver. Then in a year or so, the Volvo would become our third car, as we have two teens in the house, and I would get a fun car for me. Thinking about a Porsche 968, Audi TT or BMW 135is, but subject to change with some time to test drive and think some more. All would have 3 pedals and fixed, permanent roof.

The above plan moves out to Fall when I sell my JSW back to VofA.

I will take a serious look at the AllTrack. If performance is lacking I will probably go with an Audi. Not sure which one yet. Probably an AllRoad or Q5.
