Did the math using July. Either way I'm good. Bought the car in March of this year and after trade-in only have $7K in it.

I am not sure how you owe so much on a 2011 that you bought in 2014 when put $5k down. Did you have negative equity rolled in from another vehicle? I bought my '14 in late Oct 2014 and put $0 down and I owe $19k on a 72 month loan.

it will not be the end of the world. You mileage deduction will be -$360 in October and you will have made 3 or 4 payment to reduce you remain loan balance. If CA will allow you, you may want to continue to driving the car until 2018 and buy it out then. The only depreciation you are going realize the additional mileage depreciation and your loan principal will be reduced.
The higher principal is due to the high tax and registration imposed on us here in social.
The 5k is only 1.5 k toward principal after said and done, not to mention during the time I bought these cars were premium . Took me 5 tries to even get one and all went for max Nada. VW compensation figure is 6k below the figure I used when I bought it ( I believe I still have that print out).

Here is the way the math works out for me. Bought the car in April of 2014 for around $32k. I have about 54k miles on it right now. I am in the SE region.

Buyback:

Amount from Column 1: $28,907
Projected mileage in October: 61,150 miles
Mileage adjustment amount: -$1950
Projected total buyback amount: $26,957

Modification:

Amount from Column 2: $7,307
Mileage adjustment: -$325
Projected total modification compensation: $6,982

$27,587 (east)

(+) $480 Wheels
(+) $690 Sunroof

TOTAL: $28,967

What I can't wrap my head around is the mileage question. In August of 2015 my car had 25,106 miles, so i'm mileage neutral ($0). The agreement says that you have til November of 2018 to do what you will with the car, so does that mean that regardless of the mileage you put on the car till then does not matter?

Please check my math and PLEASE let me know about the mileage question!

my 2009 JSW DSG

Buyback Modification
$13877 $4802

I have 170k, but for grins will figure just under 180k for adjusted miles (and allow for an extra 13k or so for the Oct 16 example)

-$3480 -$580

would bring the modification to $4222, which means further adjustment of $878.

so the buyback would be

$13877 - $3480 + $878 =11,275 for buyback, or $5100 to accept the modification

I may not been looking at this right but if...

Trade in value of September 2015...
•2009 9,175
•2010 10,400
•2011 13,475
•2012 14,875
•2013 17,775
•2014 20,550
•2015 18,987

Looking at todays NADA book value, I listed the retail value and then trade in values.
•2009 9,100 5,825
•2010 10,275 6,875
•2011 12,125 8,875
•2012 13,575 10,300
•2013 14,400 11,225
•2014 17,150 13,750
•2015 20,225 16,600

Does this basically means that VW is giving us RETAIL.. but at todays dollar instead of RETAIL at Pre-Scandal?

Months since Sept assume 12mo
Mileage Adjust 12mo*1042mi/mo = 12504mi
Adjustment 15000-12504 = 2496

$32291 buyback : $7871 fix (both assuming owned prior to Sept 2015)

Section XIII.I defines the modification payment (for Gen 3 cars) will be in two parts, first 2/3rds then 1/3rd. I assume this means there may be two stages to the fix.

I bought my car in March. Sections VII.E and IX.C say my restitution will be "Post-September 2015 Owner Restitution" plus "Post-September 2015 Owner Adjustment" defined in the Definitions section JJ & KK.
My Post-September 2015 Owner Restitution would then be
$28428 buyback: $4008 fix.

I'm unlikely to sell (since I bought the car to drive) and $4K buys more than just a tune which I'm itching to get.

Not sure what the difference is on Premium vs Premium Plus so I went with Premium. I believe the math is correct but will probably pass the next mileage threshold of 75k before the fat lady sings so deduct $180 for a mileage adjustment of $0.

Base - $19307
Sunroof + $660
73800 + $180
buyback = $20147

At the time of purchase (12/30/09) this was exempt from sales tax and got a federal rebate for being "green" vehicle. LOL! Man, I really love this car but this buyback may be hard to pass up.

I'll be interested in a 2017 GTI.
Pretty sure you used the base rate for an Audi A3, not the golf... 2010 golf base rate (page 4) is in the ~15k range depending on location, 2 vs. 4 door, and options.

this is true, but in the end, when your ready to move on and your car is worth 70% less lol you might be a little upset just to enjoy a little spending money now.

i will be amazed if this actually goes through and VW isnt forced to change this. if i keep my car, i get 7k right now, but my value has drop soooooooo much more than that. this is also suppose to be the "im sorry" money. i actually look up my BB yesterday for a 14 sel with 60k and it was only 12.5k. lol MSRP on sticker was 36k. pretty big fall in 2 years even with a few more miles.

No "condition factor" as they are to be crushed and junked. No need to have a nice car when the outcome is the value of scrap steel.

I hadn't thought about this, but I agree the numbers support this. IMO the best part of the proposed buyback settlement is the fixed value and those who are patient to wait to sell their vehicle back until later will benefit the most.

Hate to ask for help, but have a question. I have a 2013 JSW with a manual trans, no options, with 21423 miles.

The Math I get is as follows.

Turn Car Back in at 12 months $ 26507.00 with 21423 miles
Have car Fixed at 12 months $ 6907.00

Turn Car Back in at 16 months $27126 with 21423 miles
Have Car Fixed at 16 months $7351

Question I have is if I just park the car till im forced to turn it in or have it fixed, say 24 months, what are those #s. It seems that the buy back #s increase the closer to the maximum buyback date. It appears that if I wait till the last month to turn the car in, and dont drive it ,my payout will escalate, am I correct on this ?

I am torn on what to do, obviously im put in a bad situation just like all of us have been. Half of me wants to take the money and put it toward my Morgage, the other half likes my Wagon so much that I dont wanna part with it. The 3rd half is afraid of what a POS it will be after its fixed. And the 4th half cant find a car to replace this car with.

It is not a problem for me to let the car sit, I only owe $4000 on it thru VW credit at 0 % interest. I have many other cars to drive.

Thanks for any help I can get, the #s are getting to me, cant look at them anymore. But it appears that if I wait till the end, I could get over 30k from VW if I dont drive it anymore.
I assume your gains are from mileage allowance reducing your adjusted miles. if your paying insurance, registration and taxes, it may not be worth while. Id your looking at it as an investment, the difference between 26500 and 30000 is a return of little less than 6%.

are those NADA numbers a little low?

is there any way to verify the NADA Sept 2015 used car numbers without paying $50 for their archive service? the figures look a bit low, compared to Kelley Blue Book, for example.
My buyback numbers:
2013 Golf 4DR with auto trans and very low mileage: 24107
price when purchased used in May 2015 (less TTL): 19800
Return On Investment 4307
+ $1000 I'm Sorry Package 5307
sweet deal, but I'll still never buy a VW/Audi again (this was my 4th)

That is seriously good news for me. Had $13K in damage last September from being rear ended by a moron. It was fixed, but figured that would come into the equation somewhere. I got $4850K in "diminished value" from the settlement.

So:
Base Buyout- $27,107
Estimated mileage in October ~66K -$2430
no Auto -$960
BuyBack final $23,717
diminished value settlement $4850
total $28,567. Paid just under $28,000

sucks that factory clear bra, mats, and other "options" aren't reimbursed

Manual transmission: -$870
Mileage: Projected October = 28000 - 13546 = <15000
Mileage adjustment: +$2550

Total Buyback = $23207

Overall I am happy with this, as I will owe almost exactly $10,000 less than this come October. I paid ~25k total including extended warranty, all taxes and fees and ~$800 in negative equity, 0 down, 0% for 72 months... made every payment but not a penny more. Adding in the $500 cash goodwill money I paid overall $38/month to lease this car for exactly 36 months, and absolutely no maintenance/upkeep costs.

Thoughts:
- My car is pretty low miles which definitely helps
- I agree with those saying the high-mileage penalties are too harsh.
- I don't have a problem with deducting for the manual transmission... these cars cost $1000 less than automatics when I bought it and that is the way book-values work, so that is ok to me.
- Overall it definitely sickens me to know this is based off "trade-in" book values, and not true "retail" value. Especially for Gen 1 cars assuming there is no fix.
- I am curious if since the buy-back is based-off "Trade-in" values, if we will be entitled to a sales-tax deduction on a new car (in states that allow that, of course)... this could basically be an "extra discount" for VW dealers to encourage customers to buy another car at that dealer that day. For me it is probably the deal breaker as to whether I will get a new VW or walk.
- I would love to get reimbursed for the extended warranty and the spoiler I put on, but I guess I could take it off and sell it, and deliver them a beetle with open holes in the rear decklid ;) lol. I am going to have to take out the soundbox I bought with the goodwill package $500 dealer card before I turn it in anyway.

My NADA value as of Sept 23rd was 14750 for clean trade, average miles.

VW's Base rate (SE, MT) = $20657
($20657 - $2986.73 ) / 1.2 = $14725 Estimated trade-in value used

Appears right for me :), but the mileage adjustment is way higher from VW. I had 16k miles back in september and NADA added $1700 to my value for it, the mileage adjustment from VW is $2550. ($2040 really for 16k miles, but the way they back date it I will fall in the 10-15k range). I think this furthers the argument by high-mileage owners that the high-mileage adjustments are too severe! I am very happy to be on the positive side of this.

NADA values are almost always the lowest book values, In september my car was worth ~500 more on KBB and Black-book trade-in values.

Not mad at all. I bought this car at the beginning of October 2014 for $18,000. I've spent $2,272 so far in fuel. And I'll have paid about $1600 for 2 years of insurance on it. That puts the total cost to own this car roughly at $22,000.

Factor in the $500/$500 gift cards and I've for sure had a completely free car for 2 years...

Base Value: $20,777 + $570 (pano roof option) = $21,347
-$2,490 mileage adjustment = $18,857

Option 2:
$5,952 + $95 (pano roof option) = $6,047
-$415 mileage adjustment = $5,632

Option 1 minus Option 2 = $13,225 they are paying me for the car.

I will VERY Likely do Option 1 and it saddens me that the car would be crushed. I'll have to remove all of my mods and turn it in stock just so it can be wasted. HOWEVER I only paid $12,500 for the car with 78k miles back in August of 2013 so I'm actually making money off the car which is mindblowing.

Will likely go back to a 03-08 Toyota Matrix after all is said and done. Still the best car I've ever owned was a 2005 Pontiac Vibe (twin of Matrix) and for a practical daily-driver beater wagon they are absolutely perfect

Does anyone know if we have to pay income tax on the settlement? That would be REALLY stupid if we did and if that was the case I'd do Option 2 instead.

Paid 18K for a new 2015 Jetta TDI on 9/11/15. Picked it up right after the stop sale went into effect. Only 6K miles (road trip car - sits in the garage). Can make a 5K profit if I sell it back, or 6K if I just take the money. They've already given me 1K.

Think I'll take the 6K plus the 1K, subtract that from the purchase price, and be happy with my 11K Jetta. I've made some pretty good deals, but over 50% off the sticker price is insane.

My only regret is not buying 2 of them!

I bought it new for $25,381 in 2010. It's been the most trouble free car I've ever owned (except for Dieselgate). So I got 6 years of driving for $7,000. Not bad.

I spent a week with a rental GTI last month. One of those will look good in my garage come October.

Appreciate all the help and info here.
My situation is a little crazy since I put on so few miles (500/month).
But following the math given here, I believe my buyback amount will be MORE than I paid at retail for the car new in November, 2014.
The attached shows my calculation. Am I going wrong somewhere?
If it's even close to being right, I will have about $6k to payoff on the loan in March of next year, and would like to use the payoff dough to either (1) buy a used Tesla Model S; or (2), but a Passat TDi, assuming VW has new, 'legal' diesels back on the market by then.

The "Further adjustment" does not apply to you, your buyback would be $30887. You only do that if your subtotal for getting your car fixed ("Modification", column 2 in form 1A) +/- the mileage adjustment for modification total is less than $5100.
