No need for ED to offer, and I am not being a "baby". you should however be asking Jeff why he refuses to answer my email,send a frame, or send a refund. He is in a way representing the club. Is this the way you would want to have someone represant you?

It does not <u>require</u> mitigation, and you know it - or should! It seemed quite obvious that in this case mitigation wasn't possible due to the nonresponse on the defendant. The plaintif is in his legal right to reject any mitigation, that he feels is not fair, and take it to court.Equity requires those claiming damages to mitigate them (you understand that concept, don't you?).
The contract is between two individuals, and our agrieved fellow forum member is well in his legal right to demand that the contract be fulfilled! He is not obliged to accept a refund or replacement plate from a third party that is not involved in the contract.Our agreived fellow forum member has been offered both a replacement and a refund, the source of which is immaterial, and has not acted on either, to his own detriment.
I know how to make him happy, and it's very simple! Have Jeff honour the contract or provide a refund. It's that simple.Since neither a refund nor a replacement plate frame will make Mr. Sparetimetoys happy, there is nothing left to say.
