No need for ED to offer, and I am not being a "baby". you should however be asking Jeff why he refuses to answer my email,send a frame, or send a refund. He is in a way representing the club. Is this the way you would want to have someone represant you?

This thread has been quite funny, in a sad way! The best part was when our "Attorney" - RFRIEND, tried to argue in favor of Delinquent Jeff! That was a good one!

I keep forgetting that there must also be attorneys that finish at the bottom of their class.

FYI, Jeff sent a large donation with the proceeds from these plates. $475 was raised this time around and he still has plates remaining. It is not a scam in case you are worried. He just sends this out all in bunches every few weeks, so turn around is a little on the longer side

Well, you are not even close.
Equity requires those claiming damages to mitigate them (you understand that concept, don't you?). Our agreived fellow forum member has been offered both a replacement and a refund, the source of which is immaterial, and has not acted on either, to his own detriment. The allegations that Jeff has not contributed to Fred have also been refuted. The problem with behaving the way both Jeff and Mr. Sparetimetoys have behaved is that it rarely produces the desired result. Since neither a refund nor a replacement plate frame will make Mr. Sparetimetoys happy, there is nothing left to say. This horse has been beaten until it is dead, its carcass dragged through the streets, and its head placed on a pike outside the city gates. Expecting it to come back to life is somewhat unrealistic.

Yeah, you are right, but we put them in sales where they can't harm anyone or give the rest of us a bad name!

It does not <u>require</u> mitigation, and you know it - or should! It seemed quite obvious that in this case mitigation wasn't possible due to the nonresponse on the defendant. The plaintif is in his legal right to reject any mitigation, that he feels is not fair, and take it to court.

The contract is between two individuals, and our agrieved fellow forum member is well in his legal right to demand that the contract be fulfilled! He is not obliged to accept a refund or replacement plate from a third party that is not involved in the contract.
Since neither a refund nor a replacement plate frame will make Mr. Sparetimetoys happy, there is nothing left to say.
I know how to make him happy, and it's very simple! Have Jeff honour the contract or provide a refund. It's that simple.

You see, it doesn't take an individual with a law degree to figure this one out. Once again we are shown the ability of lawyers to turn something very simple into a more complicated issue!

I guess rfriend slept in class the day they talked about specific performance. By the way Fred is taking care of this per an email to me. I will close this when it is done.
