Sure, write another law that says those cars aren't allowed based on whatever BS reason they want. Outlaw registration of vehicles bought back by a manufacturer as a safety concern with some BS wording in there about "lemons", while it still applies to all of the TDI vehicles.
I know CARB will try to do something to ban them from being sold; I just wanted to know if the agreement that supposedly will not allow CARB/DMV to deny registration to owners who don't accept either the fix or buyback also addressed the sale of fixed cars. If it doesn't, then CARB can arbitrarily ban them from CA; if it does, then CARB will have to figure out how to get around the ban, whether it be legally or illegally.

Most likely, it will take either a bill in the legislature or an executive decree from the governor to make whatever they do, legal

VW offered $2,000 "loyality dollars" to TDI owners last October after the scandal broke. .

Still waiting - they did not offer me anything!

I bought my VW used in November 2013 and they had my name, address and Jetta VIN number for sure.

The agreement allows VW to sell "fixed" cars. As for CARB preventing it, there is enough "mitigation" payment to allow 85% of the cars to be fixed, and NONE to be scrapped. I don't know if this is enough, but I suspect VW will have a case against CARB if the latter denies resale of bought-back and fixed cars.

Not that many turned-in vehicles may not be worth fixing (condition, mileage, etc.) so only the best are even candidates. My magic 8-ball seems to be suffering from high NOx levels in the air:D, so it's hard to know what VW's plan really is.

Edit: the mitigation and penalty numbers are calculated separately for California, so I could see CARB preventing bought-back cars from outside CA being brought in. But they've already agreed to allow 85% of those already there to be fixed and kept on the road.

Diesels are made to be driven, not parked. You should take the buyback as soon as possible and use the money to buy a more appropriate vehicle for your driving conditions.


I park my F350 7.3L Diesel pickup and a Ford 1310 Diesel tractor most of the time and they do not seem to mind :D

Is there anything to prevent VW from fixing the buyback cars, then making them available for sale as used or even CPO? What about the unsold dealer stock; could they be fixed then sold under a CPO label rather than "new"? Is there anything in the agreement that would prevent CARB/EPA from banning such cars?
I wouldn't call them "CPO" (has a bad taste in my mouth from buying my 2000 NB), but I don't think there is anything preventing sales as "USED" with a replacement ECU and the other fixes required for the model year.

The person you quoted is either confused or misinformed. I believe they are referencing the $2000 owner loyalty bonus off a new VW that was offered to any VW owner for a few months after the scandal broke to help boost sales.

As long as you received your pair of $500 cards from the goodwill package you have everything you are entitled to as of today.

VW better offer AT LEAST another $2000 owner loyalty bonus offer to TDI owners come buyback season.

I wouldn't call them "CPO" (has a bad taste in my mouth from buying my 2000 NB), but I don't think there is anything preventing sales as "USED" with a replacement ECU and the other fixes required for the model year.
I figured that was the CLOSEST term for the unsold 2015/2016 models since they are not "used" but WERE "pre-owned by the dealership.

As for the buyback cars, perhaps VW could sell most of the Gen 3s as "CPO"s, but the Gen 1s & 2s would not qualify for anything other than "Used" (that is assuming VW doesn't just crush them).

I too (along with 1000's of tdi owners) got NO notice. There should be a separate suit for this insult.

Mitsubishi's plant was the last one to have a UAW "relationship". That relationship was so good the plant shutdown last November!
I work at Tesla motors......I wish it was Union! Long hours, poor working conditions, dam slave drivers!

I'd bet they sell the "new" ones as demos vs CPO. Think they would offer less warranty that way and technically the cars aren't used. When I was out car shopping my local Volvo dealership had their 2015.5's on the lot as demos. They were offering the original 50k mileage warranty but the 3 year period started in January so you got roughly 2.5 years or mileage whatever came first. Now granted that was Volvo not vw so I could be off base again.

Heck at 121k miles, I'm nervous that HPFP or my Timing Belt will go during the 7 mile drive to the dealer. Or, since I live on a barrier island in NY, that this September we'll have another Sandy. I'd love to keep it for a few more months to a year so I can lower the mileage calculation and get a couple hundred more bucks, but the agita would eat at me worse than the sea air does to my cars.
The requirement is that the car arrive at the dealer under its own power; no requirement that it be 100% operational so if you can drive it in limp mode to the dealer, then you've met the requirement. The requirement is there so people don't haul in totaled vehicles on flatbeds expecting to get several thousand each.
I parked my Sportwagen months ago and plan to take it to the dealer on my car trailer, I'll park a couple streets over and drive it in, I'm not going to tag it next month or put collision back on it to drive it 40 miles to sell it back, and hell my luck is so bad the damn thing would explode on the way there. I'm enjoying my GTI now more that I parked the TDI:D

Absolutely. So can VW dealers.
Depending on how long they have been in inventory though, the VW dealer ones may be ineligible for the settlement.

The German state of Bavaria said today that it will sue Volkswagen for state pension fund damages caused by the diesel emissions scandal that came to light last September, making it the first regional government in Germany to try and bring the automaker to court.

VW’s shares plummeted after the scandal, which in turn led to a financial hemorrhage of civil servant state pension funds, reports Reuters. All in all, Bavaria, which is home to BMW, lost about €700,000 ($783,580), the finance ministry said. And the people aren’t happy about it.

Writes Reuters:

Bavaria’s pension fund lost out from the fall in the shares, Bavarian Finance Minister Markus Soeder told German news agency Deutsche Presse-Agentur (DPA), his spokeswoman said. “We want this money back,” said Soeder, a member of the Christian Social Union sister party of Chancellor Angela Merkel’s Christian Democrats.

Soeder said Bavaria’s pension fund would file its suit against VW in September at the regional court of Braunschweig near VW’s Wolfsburg headquarters in the state of Lower Saxony, according to DPA which reported the legal action earlier on Tuesday.
This is a tricky suit because, despite VW’s wrongdoings, the state of Lower Saxony, which is where VW is located, has a 20 percent stake in the company. This is a suit that involves one party of financially hurt German citizens potentially hurting another party of financially hurt German citizens.

What a mess.

wow. seriously.

btw, drove my cousin's diesel Cayenne from Denver to Steamboat and back... fit and finish is obviously incomparably finer, but i really didn't enjoy the powertrain any more than my Golf! was kind of expecting to be blown away... it did handle triple digits as if we were cruising residential streets, though.

Not great news for VW. But just a minor bump in the road. They just reached their goal of global domination as the largest automaker in the world. VW is going to be just fine.
