Pretty much. All nicely approved as proposed. Lawyers are happy, the government too. Owners...??? I imagine the settlement website will crash early on the 28, with the avalanche of pissed off TDI owners trying to submit their claims...the joy!:rolleyes:

The "fair market value" at trade-in is for the purposes of a tax credit at time of trade-in. That is determined by the government's tax tables.
But you get top-up to the value at Sept. 2015.
Example: fair market value today on a 2013 TDI is $10k, but on the day prior to the scandal becoming public, the car was worth $15k. You are trading it in at a VW for a new car worth $25k. You get:
$10k trade-in value for your old car
$5k top-up money to bring that value up to $15k (Sept. 2015 value)
$5.5k cash settlement
------
Total: $20.5k
New car thus costs you $4.5k plus tax and delivery.
Tax is calculated on value of the new car minus fair market value ($10k) of the old car. VW has no control over this, it is how the tax system works. So if the tax rate is 15%:
($20.5k -$10k) x 0.15 = $1575
So the new car costs you $4.5k + $1575 = $6075.
my issue is, that 5000 x 15% tax loss (HST) is $450 bucks,, so no mention of that loss we face ..and add the $300 admin fee the new car will want, plus the $100 air conditioning tax for the new car. it kinda takes the shine off the sorry cheque..

Finally! Thank you VW for a very generous payment and for providing me with the ability to purchase A6 TDI. By letting me drive my Passat for 4 years with literally no depreciation.
For all of you that feel you got screwed over, please move along to your Electric vehicles and Toyota Prius.

Now let's get 3.0L TDI settlement under way.

Not sure if I'm reading too much into this: so they make an announcement today that a settlement has been reached ... But weeks earlier when the court hearings where about to commence " they always maintained that the claims process would be ready to roll out no later/sooner than April 28,2017... Which is now the actual date for eligible claimants to register on the portal or by mail. Were the past two weeks just a smoke screen? I mean , I'm really happy it's finally gonna get started, just don't know what was reached over and above in the last couple weeks???
Not a smoke screen, but rather normal legal proceedings necessary for such case. People tend to think it's a smoke screen, because the judge approved the settlement as proposed by the negotiating parties, without improving the buyback amounts on any way.

Ok....so Judge said the deal isnt fair and then went ahead with approving it? Am I missing something?
It seems that the Judge has just said it is fair. When did he say it was not?
can someone explain me why we were able to sent objections if none of those has been taken into consideration anyway?
Of course they were taken into consideration; that is why the Judge took two weeks to review them. In the end, this is a class action settlement. A settlement means a compromise from both parties.
Anyone notice that the trade in value is the fair market value at time of trade in?! And not the wholesale value as of Sep. 2015?
So in essence we lose trade in value because it took so long to settle ...
Or am I misreading this ... Please correct me if so.
Yes, this was stated in the first release of the proposed settlement last December.
In my opinion, this is a generous settlement and like anything else, there will be people who agree and those who disagree. What I am looking forward to, is Fred'sTDI returning to what it use to be.
Oh, just wait for the VW Canada trade incentives that they'll introduce shortly - I'll take two!

Actually, is it really over:
THIS COURT DECLARES that this Order will become effective only if and when the
Settlement Agreement is also approved by the Superior Court of Quebec

Read the VW news release. The Quebec court has also approved the settlement.

both the Québec and Ontario Courts have granted
approval of the nationwide settlement agreement

I am among those who agree. I think it's fair. We're getting a brand-new wagon out of the deal, for $3k plus taxes and delivery, and that's just based on MSRP without any incentives. I'm pretty sure VW will try to get us back into the showroom. So the actual amount for our new car might be quite small. Brand-new car, with no payments, warranty reset to zero, newer generation so base model better equipped than our previous generation Comfortline, what's not to like? I think it was never realistic to think that VW would give a full refund.

My only worry now is not enough new vehicle's to go around for everyone. (those who choose to trade in). I'm eyeing a wagon hiline 4motion, just hoping they'll offer a manual in the next model year, otherwise I'll have to settle for an automatic for the first time ever.

I'm satisfied with the settlement. I'm seriously considering to trade in for an e-Golf. With the trade in vale of my 2011 Golf Wagon Highline plus the 14k Ontario incentives on an EV, it looks very appealing to me.

It's a good deal for those that wanted out quick at any cost. Also VW and the class lawyers won big with their cozy arrangement. Otherwise it just stinks.

Guess I will just have to invest in a good pair of nose plugs and move on.

I really think you make the deal look worse that it actually is. You know well, that you cannot please everyone. This is a good middle ground, in my opinion.

Seems to cover all the bases especially for those owners that have a car which needs a couple thousand dollars work on them to continue use and are parked so they can hobble in to the dealer April 28th. The rest of us can afford to wait to see if VW will upgrade the specials for trade in value. Another year of driving and still getting the same deal has some value, maybe Vw will bring back the TDi by then or a suitable hybrid. So get in line the junkers will go first as usual.

Looks to me the only way to find out the real value is to get an appointment after April 28th and have the 20 day value assessed. But like you I am looking to find out before I go in.

With the "news" of settlement I headed over to the settlement site and seems it can't be found... thinking it's seeing a bunch of traffic and crashed this morning or the link from in the settlement e mail from VeeDub is incorrect. Sigh... says error 404 server can't be found.

I've not messed with any calculations and if I had the following:
2015 Comfortline Sport Package
6 speed manual
55,000 Kms
Purchased Sept 11, 2015
Phase one fix completed

Questions:
What values would I be looking at?
If my outstanding loan for the car is more than buy back, plus sorry money I'm still on the hook for this?
If I purchased optional warrenty coverage what happens to that value?

Thanks for any insights in advance.

Not a horrible deal but there is a subtle bad smell in the air. Maybe I stepped in something on my walk this morning.

I had a sense this might happen and back in January when the then-proposed settlement was tabled my wife and I had a little parley, since it will be her car. I told her if she wanted a manual wagon in her colour choice, it would be best to order sooner rather than later.

So at the end of January we ordered a silk blue TSI wagon, Trendline with connectivity plus, 5-sp manual. Checked two weeks ago, car was showing as built, in transit, estimated delivery April 21 (yesterday). So I expect news any day now.

The settlement is good until the end of next year I think, so it's still possible to order what you want if you're willing to wait a couple of months.
