The Restitution amount may be considered income however the buy back value would not. IMHO... And how about the Goodwill gift cards? Maybe but I never got a 1099.
I am not a lawyer, etc. However, normally, lawsuit settlement amounts are not typically considered income.

There are three separate comment periods, one on each agreement. The commenting requirements and time periods are different for each.

All you guys looking to make quick buck off of Vw. You have to report your buy back check as income to the IRS.
You would be off better waiting. The fix might make the car run better.
Source? This is not income. The buyback is loss and the compensation restitution is a lawsuit settlement payout which is generally not taxable.

This is not true as a general proposition. This particular settlement is designed to reduce or eliminate tax liability in most cases, but it's more common that lawsuit proceeds (whether by verdict or by settlement) are taxable than not.

What 3 agreements? Do you have links to where to send comments for each and what the three agreements are? (I assume you are saying court settlement, FTC consent decree, and something else?). The FTC Consent decree specifically references and relates to the court case and the email address I saw, which I believe was for the consent decree (but I could be wrong) is a DOJ address, not an FTC address.

You paid (most of us) income tax on the money used to purchase the car. The car is returned to VW and your money (less than original amount paid) is refunded. Are you required to report as income anything else you may have purchased and returned?

Now, if you receive more from VW than you originally paid maybe that portion would be taxable as a capital gain?

What's wild is that the further out you estimate the buyback date, if you are paying a loan down in the meantime, obviously your return goes up, but even in just under a year, that can mean a lot of "extra money" since they have sort of frozen the buyback amounts based on the Sep 2015 values.....

I wonder when they'll have the "fix" timeline details....

Just returned from a 1700 mile road trip. Went online to register this afternoon after a long sleep. Official and unofficial numbers ended up with a whopping 23 cent difference. Basically $34157 for a '15 Passat TDI SEL with 26000 miles by Aug 17. Used that date since it will be due for emissions testing then and MD is still acting strange. Can't reregister the car until emissions testing has been passed. Could be a mess.

Anyway, since I paid $29.6K out the door with no loan, it is hard to be unhappy with the offer. But the real problem is that it is one of the best cars I've ever owned. Performed beautifully on the trip on every kind of road. Got to the bottom of the registration form, and could not make myself hit 'submit'. Will need more thinking time.

I was right there with you when my 13 TDI SEL was at 28000 miles! I LOVED the car!! We used our Passat for many road trips and it was comfortable and got outstanding milage. Fast forward to around 55000 miles and the glitches began. The first one was the reductant tank heater. This is the ad blue tank heater went out. I live in South Texas where it's not important but it does give a check engine light and I'm the type that can't drive around with that on my dash. I used my good will package money to buy the part and did the work myself. VW of America was not interested in helping out with the repair cost and said it wasn't an emissions item even though it is. Within the next 6 months I had issues with the door lock actuators not locking and trying to lock continuously while driving, followed up by an ad blue countdown to no start 200 miles popping up twice now and going away within 100 miles.

These cars have all of these known quirks that pop up on a LOT of our cars, and I mean A LOT! I've seen hundreds of other owners if not more with these same issues! I agree with you, I Love the car.....when it's running as it should, but ultimately I think these cars have emission problems going beyond the Diesel gate cheating. I think when VW put these new clean diesels in the US market they added so much crap to satisfy the EPA we became test pilots for the "clean" diesel market. You may put over 100k miles without a hitch, but in my opinion you would be more the exception than the norm if you make it that far. We are at 78K now and I'm apprehensive overtime we drive it waiting for another ad blue/ emissions item to fail. After my experiences, the buyback can't come fast enough. Best of luck in your decision, I just wanted to share my experiences.

loan payoff or no?

$25,516 is what it looks like my check will be on 11/1 for my 2014 tdi beetle convertible with 65,000 miles. I think my mileage will actually be higher than that, but it should still be reasonably close to that amount.
Just curious, I own a 2014 Jetta TDI with approx the same mileage..is that 25K check with or without a loan payoff?

The loan payoff is irrelevant to the payoff amount, it's just deducted from it, except insofar as VW will pay up to 130% of a loan amount (in which case the owner gets nothing, but of course makes out to the tune of that 30%, if applicable).

My pleasure! BTW My Passat must have heard me talking bad about it. My wife just called and the 200 miles to shutdown message just came back on LOL! I guess I'm parking her and her next drive will be back to the dealer. I already replaced the VW with a BMW 535i gasser but my wife is still too afraid to get the new car scratched or door dinged so she's been driving the Passat.

We have 2 eligible TDIs in our family and decided today to go ahead and register for the buyback of our 2011 Golf 4D MT w/sunroof simply because the cars trade/sale value took a "hit" when we got rear ended 2 summers ago.

So we'll have $20,566.73 (car is paid for) towards it's replacement. I'll post the cars we're looking at to replace it in the other thread here.

Our other car is a 2014 JSW DSG sunroof/power seats which we bought in May 2015, when we traded in my 06 GTI. Obviously we love the TDI engine and it's the perfect power plant for a wagon. We are not overly enthused about the DSG, but for the most part it also "fits" the wagon.

For this car, we're going to wait and see what folks report about the "fix" and make a decision. The car is not even broken in, so the estimated buyback would be more than what we paid for it (trade included) and opting for the fix/restitution would make for an insanely inexpensive awesome wagon.

Just checked my buyback value. $9525 for a 2010 JSW with 310,000 miles. If I keep it for two more years, continue to run the wheels off it, I can still get $9525 for a then 8 year old car with about 400,000 miles on the clock. Sweet!

Wow, you got me by a lot. I thought I had a lot at 183500.....

Maryland currently exempts diesels from testing, do you have an indication that it will change?

I might well be worried for no reason, but hybrids are no longer exempt here. And someone in Annapolis might wonder why diesel drivers aren't contributing $14 every few years to the state coffers. I also can't believe they actually put diesels and electrics on the same line in that appendix. Elon Musk would throw a fit if he saw that. I would like to keep mine to the last moment, but in a Blue state anything is possible. Of course, the biggest risk that I fear is the car being stolen. Then I would be SOL.

Because if there's a loan, there's a lien, so the title is encumbered.

With a lien against the car --- you do not own it. -- The lender does

Both your name and the leinholders name are on the title, same as a house. You both own it, actually. Leased car, the leasing company owns it. Driver has no ownership.

Now to find something new and not VAG to buy on Jan 2,2017....

When you go to the registration site there is a series of questions. Do you own the car now? When did you sell it? etc etc that will get the info they need. You don't need the name of the buyer but the date you sold it.

If I sell my 2013 back I should get $22,300. According to the site, I can keep the car up until Sept 1, 2018. I see everyone saying that they want to get rid of the car ASAP. Is anyone else thinking they will just hold on to the car for as long as possible, since the value will stay the same?

July/Aug is when VW discounts the previous year models. Im thinking Aug of 2018 would be a perfect time to pick up a 2017 model VW for dirt cheap.
