Can a VW dealer sell a used TDI?

I was told that not only can't a VW dealer sell a new Tdi, but even used ones are prohibited.
It seems that if they don't call it a certified preowned they can sell the car.
Is this correct?
What determines if the used car will be a certified or not?
How about non VW dealers?

My understanding is that dealers can't sell new or CPO TDIs. That's it.

Both VW dealers and used car dealers have been selling used TDI's since the news broke.

Per VW directive...there's a stop sale order on all new TDI's and certified pre-owned TDI's.

If they knew months ago that they were going to be buying the cars back (they had to have seen that was a possibility at least six months ago)...I'm puzzled why VW didn't put out a stop sale order on ALL '09-15 TDI's. As so many people were trading in TDI's for TSI's...that would have been a great opportunity to get some of them off the road for cheap (and prevent having to compensate new buyers).

Earlier this week, Findlay VW in Henderson had two 2015 TDIs for sale, both CPO.

I've bought two used TDIs from VW dealers since last September, but neither was a CPO. One was just over a week ago.
