3.0 Sales Tax Based on Current State Registration?

For anyone who has already turned in a 3.0...

Was the amount of your sales tax refund based on the sales tax percentage of the state your car was currently registered in or the state the vehicle was registered in in November 2015? The various court documents indicate that it's the state the car was registered in in 2015, while I've seen VW documents that seem to indicate the current state of registration.

Step 2A in this document indicates that the tax refund is based on where the vehicle was registered in September 2015:

Slides 19, 21, 25, 28, 30 and 33 of the "PSC Presentation: Preliminary Approval of 3.0 Liter Settlement" found at the link below indicate that the tax refund is based on the current registration of the vehicle.

It does not ask you about previous registration when you do the claim so not sure how they would know.

That could be determined by DMV records/ CarFax/etc. It could be determined (with a few exceptions, most likely) as part of the review process after your documents are accepted.

Do you know what state or percentage was used when you turned yours in?

They dont give you a break down of payment so no idea.

Yes, I'm certain. It's how it's written in the settlements and I have a credible source.
I don't think it's completely clear in the settlement documentation. For example, the Final Approval Order refers to a separate document that contains information about how buyback amounts are calculated:

"Vehicle Value is the Base Clean Trade Value adjusted for certain options and, in the case of Eligible Owners and Former Owners, for mileage. (Dkt. No. 2894-1 at 7 ¶ 15.)"​

This separate document (Document 2894-1, aka Exhibit 1A) states that the variable component of compensation consists of

"state and average local taxes on the Vehicle Clean Retail Value using the tax table attached to this Exhibit."​

There is no explanation of whether this is the state of current registration or state of registration in 2015.

Exhibit 1A also states that NADA values are

"based on the NADA Region that includes the state of the Eligible Vehicle’s last known vehicle registration as of November 2015."​

Again, no mention of sales tax, but consistency would indicate that tax is also based on the state of registration in 2015. I'm not sure from the documents which one it is. What are your thoughts? Also what is the other source you mention?
