Was driving sunday in Palm Springs and I was rear-ended by a dodge ram.
Im devastated I live in Vegas and I have to leave the car in Palm Springs till its fixed, the rear cargo door and bumper are toast. Talk about a huge bummer. Being the car is brand new I wonder how long it will take to get replacement parts.

i would be hella P.O'd. i think if you want to you can sue for the lost money on the car and for your wasted time be cause the car will now forever be listed as "been in an accident"

dont quote me though. im 18 and dont know so much bout that thar legal system. seems like you can pretty much sue for anything these days though...

you alright?

Sorry to hear, that is very frustrating with any car but much less a new one. Main thing is you're okay, cars can always be repaired while people not as easily.

Agreed, in the future that could impact the car's value but one cannot sue for that loss of value because there is no way to measure what that lost value is. If the guy was cited for wreckless driving or drunk driving then you could sue for damages (I'm sure your insurance company will so they don't get stuck with the bill) otherwise there is nothing one can do.

It sucks big time though.

The fact that your car has been involved in an accident does indeed lessen it's value . Whether you are or you are not able to make a claim for "loss of value" is a state by state issue . In Pa. the insurance industry lobby has enough influence that we citizens are unable to pursue a claim with the offending party's ins. carrier . That is not the case everywhere . I suggest you research the issue and determine from what you have learned what your next move will be . First and foremost do not have a conversation with the offenders ins. co if you can help it . First Gather your info and then speak to them and push them for an additional sum of money to compensate you for your loss . Do not try to recover money's for your time , that would not serve you well . If your dealer is willing ( they should be ) have them provide you with two written appraisal's . One as a car that has been damaged and had body and paint work and the second to reflect a car that has never been damaged . I would try for $2000-$3000 . Also , just as important will be" YOUR" choice of repair facilities . If you don't know , find the very best auto body shop in "YOUR" area . Make there ins. pay for your vehicle to be towed to that shop . That is your right , do not lose sight of that important fact . Before work commences take photos of the damaged area . Inspect the work carefully when you pick up the car and keep an eye on the paint work for several months thereafter as substandard repairs might not show up initially . Paint and body fillers can change over time . They can shrink or fracture or show sanding lines etc...
