I believe excluding emissions fix on salvage titled vehicles would be in violation of the clean air act

IF the vehicle is ineligible for compensation per the settlement, how about the emissions modification to make them compliant?

I have some TDI vehicles where the claims were rejected by VW as “ineligible”. I should note that some of these rejected claims had valid buyback offers at one point. Does this mean that these vehicles are no longer a part of the class action, and I can pursue separate legal action?

Don't think this is a case for FTC to enforce. We need to bring this to the EPA.

Great summary. Glad you'd also noticed the slight differences in the US 3.0L and the Canadian versions. I've wondered why VW didn't try to change their US 3.0L settlement also to an "or". Is it possible that the EPA/CARB/FTC denied the request?
