If the car gets totalled you get the insurance check, plus the restitution. Since the insurance values are usually somewhere between private party and retail values, and include sales tax, the payment might not be far from VW's numbers. It might not be worth fixing to drive in. Just something to consider, because every situation will be different. Hopefully nobody has to find out.
Regarding the fix and restitution for 2015 owners, the proposed fix is supposed to have two stages. Stage one is software, and you will receive 2/3 of the restitution upon completion. Stage two is exhaust modifications, and you will receive the remaining 1/3 upon completion.
They anticipate being able to do the software almost immediately, and the exhaust to follow about a year later.
