Emissions Modification Submittal Dates

I am waiting for the fix and was curios what the timeline was for the emissions modification submittals so I looked them up. The EPA and CARB are to use their best efforts to approve or deny the submittals within 45 days of submission. Here are VW's submittal deadlines if anyone else cares, this is from Exhibit 1 Benefits paragraph 15:​
15. Approved Emissions Modification.
Eligible Owners and Eligible Lessees will have the option of having the emissions system of their Eligible Vehicle modified if Volkswagen

submits, and the responsible governmental authorities approve, an Approved Emissions​
Modification for their vehicle engine. The expected and final dates for Volkswagen to​
submit proposed Emissions Modifications for each vehicle engine generation are shown​
in the table below and are detailed more fully in Appendix B to the DOJ Consent Decree.​

Class Members will receive VW Class Updates to keep them apprised of this process. If an Emissions Modification is approved for a Class Member’s engine and the Class Member chooses to have their Eligible Vehicle modified,​
the Class Member also will receive the Restitution Payment and an Approved Emissions Modification Extended Warranty described in Section 4.3.5 of the Class Action Agreement. However, because the remedies available to Class Members include a contingent option, if there is no Approved Emissions Modification available for a Class Member’s Eligible Vehicle by May 1, 2018, that Eligible Owner or Lessee shall have a second opportunity, from May 1, 2018, until June 1, 2018, to withdraw from the Class Action Agreement.​

Gen 1 final submittal deadline 27 January plus 45 business days (we are dealing with government here) comes to the end of March. That's when we should know if there is a Gen 1 fix or not. Sooner if we are lucky.

I think patience will pay off.


it is at least a little frustrating to not see any details of what is going on.

has VW submitted any/all of the proposed fixes?

what happened since?

how close does it look?



remember these dates were shared with us in June. no updates at all on specifics since then.

I understand that they want the process to work in its own time.

but for those with little patience, the buyback is an option.

I believe it's still subject to the gag order that was initially agreed to. Information only gets released "as needed" when both parties agree.

The only thing we can infer at the moment, is that VW did not submit the gen 3 proposal at the initially expected date (but the deadline has not passed).

Or that the submittal was not made public.

you are right, nothing is late yet.

Posted elsewhere but worth mentioning here. The Gen 3 (EA288 / model year 2015) fix has been approved.

Elsewhere in that article, it states that fixes for other generations have been submitted but not yet approved.

The remedy won't apply to older Volkswagen and Audi models which date to 2009. Volkswagen has submitted fixes for those models, but the EPA and CARB haven't yet approved them.

Thanks for finding this.

no mention of when potential fix for gen 1 and gen 2 were submitted, or what the status of review is.

There are just too many to list....
So I might yet be able to buy a "new" 2015! :D

I wonder what kind of deals they will give for them... probably not much knowing Volkswagen. But we'll see.

My Sprinter arrives this week, so at least I'll get that before the EPA axes them too.

May be a light at the end of the NOx-filled tunnel, though. Ford announced a diesel F150 for '18! :) And the restyle actually makes the truck *almost* OK to look at.
