I doubt that. The longer they delay the more people they have to pay to work on this. They said support line has already received 100,000 calls. The more cars they buy back the sooner they can start getting rid of employees.
I sure hope so! I can't wait till VW Claims sets me up with an appointment for the vehicle turn in so I can get my buyback money and a buy a brand new car! The biggest inconvenience this is going to be is I'm probably going to have to rent a car for a week for car shopping. My buyback money is absolutely NOT going back into another VW vehicle.

Loved the way Judge Breyer addressed every objection. Basically thanks for your time and interest but don't let the door hit you on the way out.

It's not bad, just not generous either.
But I get the logic. Adding proof of mileage at Sept 2015, as some suggested, would add more time/delays trying to sort through each claim. However, the reasons - courts feeling this will significantly add pollution to environment during this delay, is a bit exaggerated.
You could always have opted out like 3600 people did and sue VW on your own.

Tried this with my local VW dealership, as I had my eye on a Tiguan. They said they hold cars for two weeks, MAX, and practically hung up on me when I told them my estimated turn-in date (according to the claims portal) was Dec. 15th.

They have over 300 registered TDIs in their region... this is going to take a while.

Judge didn't address if Settlement was equitable within the class, from my "scan". It's basically tough luck, if the "Compensation" payment merely offsets expenses, between fees, fraud exhaust work, and the retail/wholesale spread.

The clean trade vs. retail rationale: "Using the NADA CTI value thus benefits Class Members, as it does not reduce benefits if their vehicles are in less than clean condition."

Breyer's rationale is that VW, and the Press's, maintenance of "$5,100-10,000" of compensation is just, when all it did for many was get them back to even, as if VW did nothing wrong.

I won't be bailing, but wish the long list of opt-outs satisfaction.

Leases have nothing to do with it. It's about what the national average for miles driven:
"12,500 miles of driving
per year for each vehicle—an allowance that was negotiated—is more generous than the average
driver’s estimated annual mileage of approximately 12,000 miles"
Exactly. The average driven was 12,000, went to 15,000 years ago, and now is at 20,000, but the automakers have never adjusted warranties or maintenance plans to reflect the increases in driving per year......figures

The vehicle I looked at they told they would hold it a max of three business days even with a 500.00 deposit. I even told them I would buy from them and not haggle over the internet price.

No, I negotiated it down to invoice. Each dealer is handling it differently, though, and I'm a long-standing customer of my dealership. I know some dealers are holding fast to the MSRP.

Yes— and this isn't about the outliers who drive 100K a year (of which there are several on this forum). What they may or may not have expected when they bought their TDI is therefore irrelevant. This is (or was) a class action suit with nearly a half-million members. A brief perusal of the 89 page decision give some indication of the complexity. I'm still gobsmacked that it only took them 13 months and change to get a settlement approved.
The court was very careful to cite precedent (Note to those who tend to forget that this is a LEGAL proceeding and think it's all about YOU -and you know who you are- legal precedent is one of the fundamental ways decisions are arrived at in our system) that mileage reduction when calculating legal compensation in matters involving cars is pretty uniform in the precedents cited. If the average is 12K, then 12.5K is certainly adequate, if not munificent.

It's approved but watch VW be professionals at dragging their feet and move like slugs to get this moving SMH
If you've read the decision as it pertains to timelines, it will be interesting to see what additional penalties the court slaps on VW if they don't adhere to it. In short, I think you're wrong. Now, if VW gets swamped by a quarter of a million people wanting immediate turn-in, well, that's hardly foot-dragging, and as long as they substantiate such a situation to the court, well, then, things will get done when they get to it.
All academic to me, as we're going for a late 2018 turn-in date.....

Will VW send out the offer packet via the mail?

It would be nice to be somewhat informed.

I already tried to put a deposit down with dealerships around the area (Of course not a VW dealership haha) . Typical max hold is up to 3 weeks. This is why VW makes this more complicated because it screws a an actual time frame on when to have a car picked and drive it off the lot.

The mileage allowance is.....adequate. And if they awarded the settlement based on a half-million individual claims, by the time any checks got cut my heirs would collect the money, and be able to celebrate at my gravesite.

The court's reasons are consistent with the basic logic* of the case, stated very early on in the 89 pages: to get the offending vehicles off the road.

*NB: Logic doesn't necessarily have a thing to do with reality. I agree with this -and only this far. It still makes their logic consistent; arguing the extent and effects of the pollution caused by these vehicles would go beyond the scope of the case, and the judge would use one of their favorite words: "irrelevant."

VW could have handle this in a much organized manner. By setting everything up through the online portals puts everyone at a hurry up and wait stance. There are maybe hundreds of dealerships around the country and this should be handled by deploying 3rd Party VW claims specialists at local dealerships. That right there could make this more organized instead of the hurry up and wait email approval process. Even calling the Claims hotline gets my blood pressure raised because nothing gets handled. They play dumb every time I call.

I think you're just as well aware as I am why this is: it's been discussed in dozens of posts. They "play dumb" because there was no approval of the settlement until today. They were doing that because they were told to do that, coming right down from VW's lawyers.
If you are ever in a lawsuit, or charged with any criminal offense, one of the first things your lawyer is going to tell you is to DUMMY UP, keep your mouth shut until the case is settled, court's adjourned. That is all that those who have been in touch with the portal / hotline have been experiencing. The real question is, what will happen going forward? Regrettably, as to that, my Magic 8-Ball is still out for repairs.

I don't think the intent was to play dumb. The verdict was delivered TODAY, so anything said before will preface these words because they were not sure - I assume so, I imagine, We believe, After settlement is approved, etc. You get the point. Probably this will change in coming days. Also, this day in the age is all online, they did good by handling everything online. They are deploying people now in every dealership after the settlement is approved. Last thing they want is to get rapped by the court, remember they sill have 3.0 settlement. I don't think court will take anything lightly.

Here's to having a surfeit of VW dealers in the metro Boston area - I'd take any of the 20 dealers within 80 miles to return our JSW ASAP (I'm north of Boston, so including at least 3 in NH in that count).

I wish the system gave us options like that - instead of just a preferred dealer, give us a list of dealers within a certain radius, each with approx availability for taking/scheduling the return. I'll drive an extra 15 miles to get it done two weeks sooner.

Awesome news. Now I just have to change my input on the site from fix to buybuck as I'm not dealing with this car anymore. I'm sure it's been asked numerous times, but does anyone know how to do this?
