if you have a 2009-14 TDI, it has just been announced they have a fix.
"The EPA and CARB have approved an emissions modification for the Generation 1 vehicle that you registered in the Online Claims Portal for the VW/Audi 2.0L Diesel Emissions Settlements. For more information on the Approved Emissions Modification, including information on what the modification involves, the impact (if any) that the modification will have on the vehicle and the terms of the extended emissions warranty, please click here."

The new software and hardware will affect your car in the following
ways:
 Engine sound will differ from your vehicle’s prior operation. There
will be increased noise from the engine that is most noticeable at
midrange engine speeds, specifically during moderate acceleration.
Low fuel quality can amplify the sound. The change in sound will
not result in any noticeable changes to the driving characteristics of
your vehicle.
 Frequency and occurrence of special engine operating modes (such
as when and how the diesel particulate filter regenerates) will differ
from the way these modes operated with the previous software.
 Vehicle Drivability – There will be minor changes in engine torque
while transitioning between operating modes. Volkswagen does not
expect these changes to be noticeable for drivers.
 Decreased fuel economy – Your vehicle’s fuel economy will
decrease by up to 2 mpg, depending on driving style and habits.

Other interesting tidbit:

If the vehicle has been modified by the customer prior to receiving
the emissions modification in a manner that may yield a non-compliant
emissions system (for example, removal of a catalyst, installation of
parts that impact emissions or emissions-related parts, or modifications
to the ECU or computer software of the vehicle), Volkswagen may not
be able to perform the emissions modification until the customer
corrects such modification.

modded ECU, as in chip tune, like Malone? hmmm :confused:

Yup that's what it is. That's also the reason I'll wait until they get done doing the Phase 2 next year before I'll Malone the ECU and the DSG in my car. Even if you have the FLASHZILLA and can go back to stock they can still tell the ECU has been "tampered" with. Whether that will stop them from doing their software update is anyone's guess.

Will get close to $3K back on the Jetta
Had Phase 1 done in June and just finished a 2,500 km round trip around Ontario. My mileage is about the same as before the fix.

Three fill-ups along the way, though each was only about half a tank since I took advantage of 0.949 or 0.959 per liter prices thus avoiding much higher prices along the way.
