it states "if the vehicle has been modified by the customer prior to receiving the emissions modification in a manner that may yield a non-compliant emissions system...Volkswagen may not be able to perform the emissions modification until the customer corrects such modification."
So as everyone already said, for you to get the modification and receive compensation you will have to correct your car.

Given the current level of official scrutiny I'd strongly recommend not fiddling with the car until AFTER the EPA is fully satisfied and the warranty is expired.
