Buying USED '15 TDI, Phase II $$$

OK, we are reasonably sure "new old stock" 15's were never registered when the DG struck, so if you buy one of those and bring it for Phase II, no $$$ for you.

But what if you buy used '15 ? It was registered, went through BB. What happens when you, as new owner, bring it for Phase II. Anyone care to ponder this mind twister ?

Seems to me you'd get the extended warranty and that's about it.

And hopefully you get the same car back.

A car is either a buyback or a fix.
Your car went through BB, so no fix $ is applicable.

Also, you are not an "eligible owner" of an "eligible vehicle", per the settlement.

All persons (including individuals and entities) who, on September 18, 2015, were registered owners or
lessees of, or, in the case of non-Volkswagen Dealers, held title to or held by bill of sale dated on or
before September 18, 2015, an Eligible Vehicle in the United States or its territories, or who, between
September 18, 2015, and the end of the claim period, become a registered owner of, or, in the case of nonVolkswagen
Dealers, hold title to or hold by bill of sale dated after September 18, 2015, but before the
end of the Claims Period, an Eligible Vehicle in the United States or its territories.


This section actually clarifies it better:
Eligible Owner (bought car after September 18, 2015): Owner of an Eligible Vehicle at the time of Buyback or Approved Emissions Modification

My brother purchased a 2015 Passat a few months ago, that had already had step 1 of the Approved Emissions Modification completed before he purchased it. He was told that he would still get the last 1/3rd of the restitution amount when he came back for the final emissions repair, since the previous owner had sold the car before the final step was completed.

^Yes, that makes sense.
The car was a "fix", not a buyback car. So the new owner would (possibly?) get Phase II compensation.
The OP asked about a "buyback" car, being eligible for a Phase II fix compensation. I don't see that happening.

What r11 is proposing is entirely different. He is purchasing a used vehicle which has already been processed by VWGOA via the buyback process. VW dealerships are exclusively able to purchase and resell these used "buyback" vehicles. Restitution is no longer an option for this vehicle.

You are correct, I did not read the OP closely enough.

I also add my doubts that you could receive any monetary amount for completing the final step of the emissions repair. - You'd probably be offered a free oil change, and car wash.

Or you can buy mine now and get the 162,000 mile warranty and the $2335.09 VW will pay on Phase 2 Fix.....I verified with VW that the next owner will receive this!

This may have been answered on another thread, but I've been told the Phase 2 payment will also be mileage dependent. Meaning, as you keep driving your car, the payment will go down, based on the mileage AT THE TIME it's fixed. And since there's no fix.. theoretically, that number could eventually wind down quite a bit.

Anyone REALLY know the answer? Will the clock keep running on mileage, or is it locked down at a fixed amount for the phase 2 restitution?

I made the decision to do the buyback instead of the fix based on what the VWGOA person and I discussed. The initial payment would be x number of dollars based on the mileage at turn in, and the phase 2 would be when the fix was done, again, they said the restitution is 100% dependent on the miles on the odometer.

So, it made more sense to sell them both back with fewer miles this month, than more miles in 6,9 or 12 months when/if the fix is made.

When "DanB36" and others urged that people actually read the CAS settlement, there was a reason. Certainly, anyone at this point looking to buy a 2015 should make NO assumptions until they thoroughly understand the status of the particular car they're interested in. And anything I was TOLD by a dealer would be in writing with their signature before I closed any kind of deal.....

I just spoke to a very helpful sales manager at a VW dealership who is also the TDI Specialist and been handling everything TDI buyback related for his dealership.

He said you will NOT get any money for stage 2 fix. Not a penny. He also said when you purchase the car, there is a document from Federal Govt stating that you promise to bring in the car for phase 2 fix and bring the car to EPA

This has really been one of my biggest complaints about the "Fix" solution (and to some degree the BB process). It doesn't seem fair for VW to be somewhat in control of how much money is being paid out by dragging their feet.

Here is another example of a dealer not getting their facts straights. I have the documents in front of me and it does state that the customer is expected to complete both phases of the fix. Page 1 of 6, 3rd paragraph. But no where does it state that you need to bring the car to EPA for any reason. It states that CARB and EPA has tested and certified the 2015 fixes even though the 2015's still don't meet the 2015 emission standards 100%, so if you get both phases of the fix, you are good to go. VW will remind us in early 2018 to get the 2nd phase fix.

So, if you have a car that has the 1st phase completed, you will not be compensated for having phase 2 completed?

You need to be a little more specific
1 - You are the original owner of a 2015 when DG came out - this group WILL get compensation for both phase I and Phase II when the phases are completed on their car.

2- You are the owner of a car that was BB - the dealer should have been required to complete Phase I before selling it to you. However , since Phase II has not been announced yet, that hasn't been done yet. At the least - I see this group getting the Phase II work as a recall, but I do not see this group as getting compensation for that. I may be wrong on that. However, you should get the benefit of the extended warranty.

It doesn't seem like those of us who own a phase 1 fixed tdi, bought 2nd hand after the first phase, are going to receive any money for phase 2.

I did not receive any paperwork agreeing for me to come in for phase 2. What I do expect, however, is that my tdi won't be illegible for the longer warranty that comes after phase 2 if I don't come in for it.
