Mahindra Responsible for Delays in Delivering Trucks to U.S. Dealers

[Global Vehicles USA, Inc., the exclusive U.S. distributor of Mahindra pickup trucks, called on India-based Mahindra & Mahindra to begin building vehicles for sale in the United States and commit to a launch date, which would bring it back into compliance with the arbitration clause of the distribution agreement between the two companies.
"Nearly 350 dealers have been ready to sell Mahindra trucks for more than three years," said John Perez, chief executive officer of Global Vehicles. "If Mahindra executives were being truthful when they said that the trucks would be on sale by the end of the year, they should honor that commitment so dealers can start earning back the tens of millions of dollars they have invested in the brand.
"Binding arbitration will decide if Mahindra lied to Global Vehicles and our dealers about the status of the trucks and whether they broke the law when they attempted to arbitrarily terminate our distribution contract," Perez added. "In the meantime, Mahindra is legally – and morally – obligated to conduct business as usual."
Global Vehicles believes that Mahindra improperly took advantage of an escape clause that was designed to allow both parties to walk away from the project if Mahindra was unable to achieve U.S. safety and emissions standards by June 11, 2010. Mahindra executives communicated publicly on multiple occasions in 2009 and 2010 that the U.S. launch was on track, and the company announced in August 2010 that it had received certification from the EPA to sell the trucks.

We apparently won't be seeing any Mahindra trucks on U.S. roads any time soon. The company has announced that it has no date in mind for its American introduction, and that as of right now, its progress into this market is indefinitely delayed. The hangup resides in an ever-growing legal battle between the Indian company and its almost-was importer here in the States, Global Vehicles USA. As you'll likely recall, GV USA claims that Mahindra improperly terminated its contract with them earlier this year, noting that the automaker now wants to sell vehicles directly to U.S. customers instead of going through a middle man.

Mahindra, meanwhile, says that it doesn't want to get into a "war of words" with its former importer. Also, the company has made it clear that it still wants to break into the American market. How exactly it plans to do so is still somewhat murky, however.

In the meantime, Global Vehicles USA has filed an injunction in federal court claiming breach of contract and urging the court to bar Mahindra vehicles from entering the states in the future.

One thing's for sure, this mess has yet to completely unravel, and none of it bodes well for the availability of inexpensive diesel-powered pickups in America.

Frustrated at being at the receiving end of the legal tussle between Indian utility vehicle making company Mahindra & Mahindra (M&M) and US distributor Global Vehicles Inc, dealers in America have begun scouting for franchises of other automakers.
A shame that there is no light duty diesel pickup available. I really was skeptical about the Mahindra until they received EPA certification.
Well, perhaps GM will change their mind about the 4.5L Duramax, or Dodge change their mind about the 4.2L Cummins (or maybe even use a FIAT or IVECO diesel).
Darn, I'm hallucinating again.:eek:

With these hurdles completed, it would seem production is imminent, but other factors may hinder the US launch. India’s car sales are on a dramatic trajectory upward. The sales pace combined with an industry wide parts shortage is impacting home market sales, which will have an affect on the United States introduction.

Dispute With Distributor Continues to Keep Mahindra Out of U.S.

The feud between distributor Global Vehicles U.S.A. Inc. and auto maker Mahindra & Mahindra Ltd. is growing more contentious by the day, and no solution appears in sight.
The argument, which continues to keep Mahindra vehicles out of the U.S. market, stems from a series of long delays in delivering a small diesel pickup produced in India.
Alphareta, GA-based Global Vehicles, earlier inked a deal to be the sole distributor of the 2- and 4-door trucks, but Mumbai-based Mahindra continues to refuse to ship the vehicles, contending its contract with the distributor has expired. Global Vehicles has turned to the courts to end the stalemate.
“Originally, it was 2008, and then it was moved to September 2009,” Global Vehicles CEO John Perez tells Ward’s. “And then it moved to March 2010, and then September 2010.”
Perez says the delay has put thousands of jobs in jeopardy.
“We are ready to sell trucks, and that remains our goal,” Perez says. “By our calculation, Mahindra’s delays and disruptions are putting more than 8,300 potential jobs at risk at our dealers, at the ports, in the trucking industry and throughout the supply base.”
Also at stake is the $35 million Global Vehicles paid Mahindra for exclusive distribution rights for the pickups and spent on product and brand development, as well as dealer and administrative costs. The importer represents 347 U.S. dealers who put up a large portion of that money.
Perez says numerous attempts to contact Mahindra to work out the dispute have gone ignored.

Shipments were delayed initially because diesel engines had not passed U.S. emission standards, but the trucks now are certified.
The latest order, worth $35 million and placed in September, was “improperly rejected” by Mahindra, Perez contends.
“We placed this substantial order in good faith, because we want to get down to business and so do our dealers,” he says, noting some 30,000 “hand-raisers” have expressed interest in purchasing the truck.
A Mahindra spokeswoman declines comment, instead pointing to an earlier press release issued by the auto maker in which it disputes Global Vehicles’ allegations.
“Mahindra views this order as another example of Global Vehicles’ policy of engaging in PR theatrics while pursuing an unnecessary lawsuit,” the auto maker says. “This is Global Vehicles’ continued attempt to manipulate the press to damage Mahindra's reputation.”
Perez alleges Mahindra all along planned not to honor the contract, citing the auto maker’s insistence that a last-minute addition to the original contract be made.
The added clause, which Perez refers to as the “famous clause 10,” stipulates the agreement would be null and void should the pickups not receive U.S. certification prior to June 11, which was the last deadline set by Global Vehicles after extending the original certification date three times.
Perez says Mahindra deliberately delayed the certification process until the clause went into effect, announcing Aug. 20 the vehicles were certified for sale.
“Ten days after (the clause) went into effect, they applied for certification and got it,” he says.
Global Vehicles has a federal suit in Georgia to determine whether Mahindra is violating its contractual rights.
Additionally, a request for arbitration was filed by Global Vehicles in London, considered a neutral site for settling the disagreement.
Perez says Mahindra has breached distribution contracts with others in a similar fashion.
“They’ve done it in South Africa, Australia and Italy,” he says. “They signed up distributors, let them set up (the distribution channel) and then took over. Big auto companies have ways to squeeze small distributors like us out.”
In statements, Mahindra does not directly address Global Vehicles’ allegations, but does say it is seeking another avenue to bring its pickups to the U.S.
“Mahindra believes that this is an attempt by Global Vehicles to distract Mahindra from pursuing other plans to bring its vehicle to the U.S. market,” the auto maker says. “The contract with Global Vehicles has expired. In light of this fact, Mahindra will be contacting U.S. dealers to make other arrangements for distribution.”
Despite the ongoing dispute, Perez still hopes the two sides can come to an agreement and Global Vehicles can start retailing the pickups.
“The product is a great product and has a great future in this country.”

December, finally, was to be the month when Indian-built pickup trucks showed up in U.S. showrooms. But December is all but over and the Alpharetta importer has turned up the legal heat to force Mahindra & Mahindra to ship the trucks to Georgia.
Global Vehicles USA recently asked the state revenue department to hold hearings to determine whether Mumbai-based Mahindra violated state franchise laws by acting in bad faith. Global earlier sued Mahindra in U.S. District Court in Atlanta claiming breach of contract.

Global, run by John Perez, a former Dodge dealer in Decatur, is also pushing forward with arbitration hearings in London. Perez said he has spent $35 million lining up a nationwide network of dealers to sell the four-cylinder, four-wheel drive pickups that run on diesel.
“We did what we said we’d do and we’re ready to go,” Jim Cain, a Global Vehicles spokesman, said Thursday. “If there’s a problem with the trucks in delivering them, then be up-front and honest about it.”

If a USA Company was Smart, thet'd start building a similar model... Though It's not likely...

I wish I had the capital to start something that Big.. look how the Ford transit is selling lately..

Would still like to see this as an alternative to full size diesel truck.

If nothing else, it might encourage a diesel Tacoma, Frontier, Ranger, or Colorado to be offered or a 1/2 ton diesel full size.

Why would you ever get this over an ecoboost F150?

It's a diesel.:)

F150 4x4 with Ecoboost is rated at 15 mpg city.
F150 4x4 XLT Supercab starts at $35K MSRP and it's easy to option it into the $40K plus range with models above XLT.
F150 is too darn big to fit in my garage. All the full size trucks are supersized now.

Something must be up with that 19/21 rating. A truck that size and weight with that size engine should get at least the mid 20's on the highway, maybe 30 at moderate speed.

Maybe the gearing is screwy???

One prone to believe in conspiracies might think the EPA purposely slanted numbers downward because they were PISSED that some company had the gall to make a little diesel truck in spite of all the epa hurdles. We'll show you, they said to themselves!!

No way to tell what actual mpg will be until a normal human drives one.

2600lb payload capacity, my current to big for me GMC 1500 only has 1600lb payload capacity. I prefer the smaller size with 4-doors that can handle my slide in camper built for a Tacoma but now to heavy for the current "US fat body version".

I think the mileage will be higher. Just look at all the TDI's. The FE numbers are waaaay lower than what actually shows up. Still probably not going to make 23-25/30+ though.

I wish there was an education program that taught people how diesel mileage pans out in the long run. Well our comercials say X is the MPG. However after 20,000 miles or so on the vehicle the mileage actually gets up to XX.
