I finally received the offer letter for my girlfriend's TDI. The car is registered and titled under her name only, and I was volunteered by her to take care of the buyback, so we filled out and notarized the POA form that came in the claim package.

Now, the final offer is in her name, and she is physically on assignment halfway around the world. As we have the notarized POA provided by VW, am I allowed to sign and get notarized the offer on her behalf? Or is there a different POA that we have to draft for that to happen?

Also is the VW provided POA good enough at the buyback appointment or again will we need to come up with a better one?

Thanks all.

The VW-provided POA should be fine at the turn-in. As far as notarizing the offer, it should work, but if she has a notary available where she is (military, perhaps?), it might be simpler for her to sign it herself and scan it back.

The offer document and in fact all documents including the check will likely be issued in your gf's name as the registered owner. A Power of Attorney (POA) authorization does not give you any interest (or rights) in the settlement, it just allows you to act on your bf's behalf.

I looked at the Power of Attorney (POA) form on VW's claim portal and it says it's in effect "through the completion of the buyback transaction." It's worded in a very broad way that gives VW latitude to allow it to work on basically anything that's required to complete the entire transaction. However, nothing compels VW to accept the POA just because it's been authorized, and so it will always be VW's decision. All that to say, if you want to be sure you'll have to ask VW.

As the "agent" under VW's POA, you should be able to do anything your gf would otherwise do... sign docs, etc. There are three docs on VW's claims portal that will be signed at the buyback closing. VW's POA should be sufficient to allow you to sign them for your gf. You'll see there's also a "Closing Checklist." You're required to bring to the closing a copy of a photo ID for the registered owner, as well as your own. You'll definitely want to have that with you. The way that claims checklist is worded implies VW will be allowing agents (you) under POAs to show up and complete the closing. Again, though, it's their decision so ask them to be sure.

Just so you know, the Power of Attorney (POA) form provided on VW's claims website, the one entitled "Power of Attorney For Title," which is one of the documents VW requires at the buyback closing, is not a POA for the situation you described. It grants power of attorney to Volkswagen to deal with your gf's car once they have possession of it. As your bf's representative under the POA you should be able to sign that (and other docs) for her. But, guess what? To be safe you should ask VW :)

As this below would be enough if my wife will not choose to come for last appointment.

I had to do this also. We got a general power of attorney for the offer, than the one for vw. But my husband made it through town to sign offer at bank. You should have her/send her that part of offer have her sign it and overnight it back to you. Than you will also need a copy of the front and back of her driver license when you take car in and your power of attorney they will have you sign it that way. But id have her get the offer signed. Just so they cant give you extra problems

I had my buyback on Saturday, wife and I are both on the title. She could not make the appointment. We had the POA (Power_of_Attorney_Form_v0.2.pdf) filled out and notarized.

The buyback specialist said the POA had to be uploaded and approved through the portal with the other documentation.

:mad::mad::mad:

He said my wife needed to be present, but called a manager, who approved proceeding with the buyback. The POA is for submitting the claim and completing the buyback transaction, not just the transaction. Your results may vary.

redblues, if you uploaded the POA into the claims portal, you should be OK.

I think this is people don't have idea what they are doing at VW dealerships.
It's said in their website, bring POA form even it has link to it: I think if they are trying to bs you, just show the page on their website. it's unbelievable
